Card Policy

1. Purpose of the policy

The purpose of this policy is to regulate the conditions for participating in the Kulcspatikák Customer Loyalty Card Scheme (hereinafter referred to as Card Scheme) as well as the conditions for obtaining a Customer Loyalty Card forming an integral part of the Card Scheme (hereinafter referred to as Customer Loyalty Card). 2. The Card Scheme and its acceptance

The Card Scheme is a scheme where participants in the Card Scheme (hereinafter referred to as Cardholder) may apply for a Customer Loyalty Card in the member pharmacies of the Kulcspatikák franchise network operated by Kulcspatikák (hereinafter referred to as Member Pharmacy) and the Cardholder identified by the Customer Loyalty Card may, depending on the given Member Pharmacy, obtain immediate discounts from the prices of certain products when purchasing goods in the Member Pharmacies.

The Cardholder shall accept the conditions for participating in the Customer Loyalty Scheme by completing the form for applying for the Customer Loyalty Card and signing the declaration of consent to data processing in the given Member Pharmacy, or on the www.kulcspatikak.hu website, in the framework of an online card application process.

3. Applying for a Customer Loyalty Card

Application in the pharmacies:
The Card may be applied for in the participating Member Pharmacies free of charge, without purchasing any product. In order to participate in the Card Scheme, all the Customer has to do is complete the Customer Loyalty Card application form in the given Member Pharmacy and submit it on the spot. By completing and signing the Customer Loyalty Card application form on the spot and submitting it in the Member Pharmacy, the Cardholder accepts the terms of this Policy.

The Customer Loyalty Card is owned by Kulcspatikák Zrt., which means that the Cardholder is not entitled to sell or otherwise alienate it. The Customer Loyalty Card is not a means of payment, not considered as a credit card or a payment instrument; its only purpose is to identify its holder. The Cardholder may only provide their own data on the Customer Loyalty Card application form. Following the completion of the application form, the Cardholder shall immediately obtain the Customer Loyalty Card in the Member Pharmacy.

Online application:
In the course of the online application process, the customer shall complete the form via an API integrated into the www.kulcspatikak.hu/kedvezmenyek website. The content of the online application form for the customer loyalty card is the same as that of the application form completed in the case of application in a Pharmacy.

4. Definition of the scope of those eligible to apply for the Customer Loyalty Card

The Customer Loyalty Card can only be applied for by natural persons over the age of 18; legal persons and business associations without legal personality shall not be eligible to apply for the Customer Loyalty Card.

Each Cardholder shall be identified by the identification code on their Customer Loyalty Card. The Cardholder shall accept responsibility for the accuracy of the data provided by them and shall be liable for the consequences of any incorrect or incomplete data. Incompletely, illegibly completed and crossed-out data cannot be taken into consideration in the course of card application; in this case, a new application must be submitted, of which fact the Cardholder shall be informed by Kulcspatikák via e-mail.

A natural person may hold Customer Loyalty Cards in several Member Pharmacies. The Customer Loyalty Card can be used in any Member Pharmacy. The Cardholder undertakes, among others, but not exclusively, to:

• guarantee the accuracy of their data stated upon joining the Customer Loyalty Scheme,
• exempt Kulcspatikák from liability if the benefits obtained by the Cardholder within the framework of the Customer Loyalty Scheme are used by a third party without authorisation,
• inform Kulcspatikák of any unauthorised use or loss of their Customer Loyalty Card.

The Cardholder acknowledges that the unlawful use of the Customer Loyalty Card may involve, at the discretion of Kulcspatikák Zrt.,

• the blocking of the Customer Loyalty Card,
• the Cardholder's obligation to reimburse the amounts unduly received by the Cardholder from Kulcspatikák (e.g., discount received by using a Customer Loyalty Card issued to a third person),
• criminal and civil proceedings brought against the Customer.

5. Replacement of a lost, stolen or damaged Card

If the Customer Loyalty Card of the Cardholder has been lost or stolen, the Cardholder shall be obliged to inform Kulcspatikák as soon as possible. The Customer Loyalty Card shall be invalidated and blocked by Kulcspatikák and a new Customer Loyalty Card shall be issued to replace it.

The Card shall be replaced in the Member Pharmacy, where the Cardholder can obtain their new Customer Loyalty Card immediately after having completed the application form. The Customer Loyalty Card can only be replaced if the data provided are accurate. The number of the original Customer Loyalty Card number must be stated accurately on the application form; if this number is not available, the name and address corresponding to the Customer Loyalty Card must be stated. (It is not sufficient to provide the name only or the address only, because that way the precise identification of the Card cannot be ensured.) If the Member Pharmacy cannot find a Customer Loyalty Card in its records for the combination of the provided name and address, no replacement shall be possible.

In the course of the replacement of the Customer Loyalty Card, the lost, stolen or damaged Customer Loyalty Card shall be permanently blocked, the original Customer Loyalty Card can no longer be used, and the data on that card cannot be restored.

The replacement of the Customer Loyalty Card is free of charge.

6. Unduly obtained cards

The Customer Loyalty Card shall be deemed to have been received unduly if it was obtained by completing an inadequate application form, it was counterfeited or damaged in any way, or if the Cardholder requests the Customer Loyalty Card to be issued on the basis of inaccurate data.

If the Cardholder wishes to use an unduly obtained Customer Loyalty Card, the Customer Loyalty card shall be blocked. The staff member of the Member Pharmacy shall be entitled to immediately withdraw any card wished to be used if the theft or defect of the given card has been previously notified.

7. Data Protection

The data processing rules relating to the data processing activity associated with the Customer Loyalty Scheme are contained in the data processing notice available at https://kulcspatikak.hu/adatvedelmi-tajekoztato. Participation in the Customer Loyalty Scheme is conditional upon the acceptance of the data processing notice by the participant. 

8. Other provisions

Kulcspatikák reserves the right to verify compliance with the terms of this Policy. In the event of failure to comply with the provisions, Kulcspatikák reserves the right to suspend or invalidate the provision of any current or pending benefit to the customer or to deactivate the Customer Loyalty Card of the Cardholder. If the Customer Loyalty Card is misused, Kulcspatikák shall be entitled to terminate the participation of the private individual concerned in the Customer Loyalty Scheme, including the benefits linked to the Customer Loyalty Card.

Kulcspatikák is entitled to amend this policy unilaterally, subject to the prior notification of the Customers. The notification shall be published within due time prior to the effective date of the amended Policy on the www.kulcspatikak.hu website. The amended provisions shall become effective after the effective date.

Kulcspatikák shall not be liable for any misuse of the Customer Loyalty Card or any damage caused by the loss, theft, destruction or damage of the Customer Loyalty Card.

The Customer Loyalty Card shall be valid during the entire period of the loyalty scheme. Kulcspatikák shall be entitled to amend or terminate its Customer Loyalty Scheme without giving reasons for its decision or being obliged to pay any compensation for the damages thus incurred.

This Card Policy shall be valid from 1 October 2024.
